Terms of Use

Effective Date: September 27, 2026

These Terms of Use ("Terms") govern your use of the public website at algorithmicadvantage.com (the "Website"), operated by Algorithmic Advantage LLC ("Algorithmic Advantage," "we," "us," or "our"). The Website is intended to provide information about our digital marketing business and ways to contact us. Please read these Terms before using the Website. If you do not agree with them, please do not use the Website.

1. Scope of These Terms

These Terms apply to the public Website, including any articles, materials, downloads, or tools we make available through it. They do not govern any SEO, paid advertising, social media, consulting, or other services we provide to clients. Those services are governed by the separate agreement we enter into with the client. Nothing on the Website, including a contact-form submission or request for a proposal, creates a client relationship or obligates either party to enter into a service agreement.

The Website does not process purchases or payments, and it does not offer visitor accounts or a client portal.

2. Permitted Use

You may view the Website and use its publicly available materials for your own lawful business evaluation and internal informational purposes. You agree not to interfere with the Website's operation or security; attempt unauthorized access to its systems; introduce malicious code; use automated requests in a way that unreasonably burdens the Website; or use the Website to violate another person's rights or applicable law.

3. Website Content and Intellectual Property

Unless otherwise indicated, the Website's text, graphics, design, branding, and other original content are owned by Algorithmic Advantage or used with permission and are protected by applicable intellectual property laws. We grant you a limited, nonexclusive, revocable permission to access and use the Website as described in these Terms. This permission does not transfer ownership or permit you to reproduce, distribute, republish, or commercially exploit Website content without our prior written consent, except as allowed by law.

Client names, logos, platform names, and other third-party marks remain the property of their respective owners. Their appearance on the Website does not imply sponsorship or endorsement unless we expressly say so.

If we offer a downloadable resource or interactive tool, you may use it for your own internal business purposes unless a notice accompanying that resource or tool specifies different terms. You may not sell, repackage, or redistribute it as your own product without our written permission. We may update, suspend, or withdraw resources and tools at any time.

Outputs from any SEO audit, calculator, or other automated tool are estimates based on the inputs, assumptions, and data available at the time. They are not individualized financial, marketing, or business advice, and they do not predict or guarantee results. Outputs may be incomplete or inaccurate because of input or calculation errors, unavailable data, or changes to search engines, advertising platforms, and other third-party systems or algorithms. Tools may be interrupted or unavailable. Review the stated assumptions and verify information important to your decisions before relying on an output.

4. Information, Examples, and Results

The Website provides general information about digital marketing. Its articles, resources, tools, estimates, and examples are provided for informational purposes and are not a substitute for advice tailored to your business. Before making a business decision, assess your circumstances and, where appropriate, consult a qualified professional.

Case studies, testimonials, performance figures, and other examples describe the specific circumstances identified with them. Outcomes depend on many factors, including industry, budget, market conditions, implementation, and changes to third-party platforms. They do not promise that you will obtain the same result. Any qualifications or context stated next to a particular claim or example are part of that presentation.

5. Third-Party Websites and Platforms

The Website may link to third-party sites or refer to search engines, advertising networks, social platforms, software, and other services. We do not control those third parties or their content, policies, availability, or decisions. Your use of a third-party service is subject to its own terms and policies. A link or reference does not, by itself, mean that we endorse the third party.

6. Contacting Us

If you use the contact form or email us, please provide accurate contact information and do not send material you are not authorized to share. Do not submit passwords, payment-card details, sensitive personal information, or confidential business information through the public contact form. Sending us a message does not guarantee a response or establish a client relationship. Our handling of personal information is described in our Privacy Policy.

7. Availability and Disclaimers

We aim to keep the Website useful and accurate, but we may modify, interrupt, or discontinue any part of it without prior notice. To the extent permitted by applicable law, the Website and its materials are provided "as is" and "as available," without warranties of uninterrupted operation, error-free content, or fitness for a particular purpose. We do not warrant the accuracy or completeness of information supplied by third parties. This section does not limit any right or warranty that cannot lawfully be excluded.

8. Limits on Liability

To the extent permitted by applicable law, Algorithmic Advantage LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of, or inability to use, the Website, including lost profits, lost business opportunities, or lost data. To the extent permitted by applicable law, our total aggregate liability to you for direct damages arising solely from your use of the public Website will not exceed $100.

These limits do not apply to liability for fraud, intentional misconduct, gross negligence, or any claim or remedy that applicable law does not allow us to limit. They concern only the public Website; liability relating to client services is addressed in the applicable client agreement.

9. Governing Law and Disputes

Washington law governs these Terms, without regard to conflict-of-law rules. To the extent a court may lawfully enforce this venue provision, a dispute arising from these Terms or use of the Website must be brought in the state courts located in Spokane County, Washington, or, if federal jurisdiction exists, the United States District Court for the Eastern District of Washington sitting in Spokane. Each party consents to the jurisdiction of those courts for such a dispute. This section does not override a mandatory right to bring a claim elsewhere under applicable law or the dispute provisions of a separate client agreement.

10. Changes to These Terms

We may update these Terms as the Website changes. We will post the revised version on this page and update its effective date. Changes apply from the stated effective date onward. If a change requires a form of notice or consent under applicable law, we will provide it. Please review this page when you use the Website.

11. General Provisions

If a provision of these Terms is held unenforceable, the remaining provisions remain in effect to the extent permitted by law. Our failure to enforce a provision on one occasion does not waive our right to enforce it later. These Terms are the entire agreement concerning use of the public Website, except where a separate written agreement with us expressly addresses the same subject. In the event of a conflict concerning client services, the separate client agreement controls.
